By accessing or using quomerce.com (the "Website") and related services, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Website or purchase services.

These Terms apply to all visitors, users, and customers using the Website, contact forms, waitlist, and checkout pages.

02Services provided

Quomerce provides automated e-commerce analysis services, including QuoAudit, where AI crawls a publicly accessible store and returns a prioritized report with UX, conversion, and legal/compliance recommendations.

Quomerce does not implement fixes in your store unless explicitly agreed in a separate written agreement.

Reports are informational and operational in nature and do not constitute legal advice, financial advice, or professional certification.

03Orders, payments and taxes

Orders for paid services are placed through our checkout flow and processed by Stripe, our external payment provider.

• Prices are shown in EUR unless stated otherwise.
• Applicable VAT or other taxes may be calculated and added during checkout.
• By purchasing, you confirm that submitted billing and order details are accurate and authorized.

Payment transactions are subject to Stripe terms and policies in addition to these Terms.

04Report delivery and timelines

After successful payment, Quomerce starts audit processing and delivers the report to the email address provided during checkout.

Any estimated delivery time shown on the Website is an estimate, not a strict guarantee. Delivery may be delayed due to technical issues, store availability limits, or third-party service interruptions.

05User obligations

When using our Website and services, you agree to:

• Provide truthful and complete information in forms and checkout.
• Use only store URLs you are authorized to submit for analysis.
• Not use the service for unlawful, abusive, or fraudulent activity.
• Not attempt to disrupt, reverse engineer, or misuse the Website or service outputs.

Quomerce may suspend or refuse service where we reasonably believe these Terms are violated.

06Intellectual property

All Website content, branding, copy, graphics, and software components are owned by Quomerce or its licensors and are protected by applicable intellectual property laws.

You may use delivered reports internally for your business operations. You may not resell, sublicense, or redistribute report content as a standalone commercial product without prior written permission.

07Disclaimers

Services are provided on an "as is" and "as available" basis. While we strive for high quality, Quomerce does not warrant that:

• the Website will be uninterrupted or error-free,
• all issues in your store will be detected,
• implementation of recommendations will result in specific commercial outcomes.

You remain solely responsible for decisions, implementation, and business outcomes in your store.

08Limitation of liability

To the maximum extent permitted by law, Quomerce is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or business opportunity.

To the maximum extent permitted by law, aggregate liability arising out of or related to paid services is limited to the amount paid by you for the relevant service that gave rise to the claim.

09Refunds and cancellations

Due to the digital and on-demand nature of QuoAudit, processing may begin immediately after purchase. As a result, refunds are generally not available once processing has started.

Nothing in these Terms limits your non-waivable rights under applicable consumer protection laws.

10Governing law

These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protections that may apply in your country of residence.

Any disputes shall be resolved by competent courts in Poland, unless mandatory law provides otherwise.

11Changes to terms

We may update these Terms to reflect legal, technical, or business changes. The updated version will be published on this page with a revised "Last updated" date.

Continued use of the Website after updates means you accept the revised Terms.
